INFORMATION FOR THE PROCESSING OF PERSONAL DATA PURSUANT TO ART. 13 OF REGULATION (EU) NO. 2016/679 “GDPR”

Cilli S.a.s., with registered office in Via dell’Edilizia, 4 – 20026 Novate Milanese (MI) – VAT number and Tax code 04635070156 (hereinafter, “Owner”), as data controller, informs you in accordance with art. 13 of EU Regulation no. 2016/679 (hereinafter, “GDPR”) that your data will be processed in the following ways and for the following purposes:

 

1 Purposes of treatment
A) without your express consent (Art. 6 lit. b) to e) of the “GDPR”), for the following Purposes of Service:
– conclude contracts for the Owner’s services/supplies;
– fulfilling pre-contractual, contractual and tax obligations arising from relations with you;
– fulfilling obligations required by law, regulation, EU legislation or an order of the Authority (such as in the field of anti-money laundering);
– exercise the rights of the Owner, for example the right of defence in legal proceedings;B) Only after your specific and distinct consent (Art. 7 of the “GDPR”), for the following Marketing Purposes:
– send you by e-mail, post and/or SMS and/or telephone contacts, newsletters, commercial communications and/or advertising material on products or services offered by the Data Controller and to identify the degree of satisfaction with the quality of the services;

 

2 Legal basis for processing
The provision of your data for the purposes referred to in point 1, letter A), of this information is mandatory, therefore, in their absence, we can not guarantee the service requested. consent to the processing of data for the purposes referred to in point 1, letter B), is optional and can therefore be revoked freely and at any time. In this case, please note that you may no longer receive newsletters, commercial communications and advertising material relating to products and / or services offered by the data controller, unless you request it later specific and distinct.
You will in any case continue to be entitled to the Service referred to in point 1, letter A), of this information notice.
We inform you that if you are already a customer of ours, we may send you commercial communications relating to services and products of the Owner similar to those that you have already used, unless you request cancellation (art. 7 of the “GDPR”).

 

3 Modalities of treatment
The processing of your personal data is carried out through the operations indicated in art. 4 of the “GDPR” and specifically: collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and destruction of data. Your personal data is processed both on paper and electronically and/or by automated means.
The Data will be stored on electronic and paper using the measures considered most appropriate by the Data Controller to ensure adequate security of your data Duration: The Data Controller will process personal data for the time necessary to fulfill the above purposes and in any case for no longer than 10 years from the termination of the relationship for the Service Purposes and for no longer than 2 years from the collection of data for marketing purposes.

 

4 Access to data
Your data may be made accessible for the purposes referred to in points 1.A) and 1.B):
– collaborators of the Data Controller, in their capacity as internal processors and/or system administrators;
– to third companies or other subjects (by way of indication, credit institutions, professional offices, consultants, etc.) that carry out outsourcing activities on behalf of the Data Controller, in their capacity as external data processors.

 

5 Communication of data
Without the need for express consent (art. 6 lett. b) and c) of the GDPR), the Owner may communicate your data for the purposes referred to in paragraph 1, lett. A) to supervisory bodies, judicial authorities and to those subjects to whom the communication is required by law to fulfill the purposes said.
These subjects will process the data in their capacity as autonomous data controllers.
Your data will not be disclosed or transferred to third parties for commercial purposes.

 

6 Data transfer to countries outside the EU
The Data Controller does not transfer personal data abroad.

 

7 Nature of data conferment and consequences of refusal to answer
The provision of data for the purposes referred to in art. 1.A) is mandatory. Without them, we will not be able to guarantee you the Services and supplies mentioned in point 1.A).
The provision of data for the purposes referred to in point 1.B) is optional. It may therefore decide not to provide any data or to subsequently deny the possibility of processing data already provided: in this case, it may not receive newsletters, commercial communications and advertising material relating to the Services/products offered by the Owner. It will in any case continue to be entitled to the Services referred to in art. 1.A).

 

8 Rights of the data subject
As a data subject, you have the rights under Article 15 of the GDPR, namely the rights to:
i. obtain confirmation of the existence or otherwise of personal data concerning you, even if not yet recorded, and their communication in intelligible form;

 

ii. obtain information on: a) the source of the personal data; b) the purposes and methods of processing; c) the logic applied in the event of processing with the help of electronic means; d) the identification data concerning the data controller, data processors and the representative designated as per article 3, paragraph 1, of the Italian Data Protection Act; e) the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing;

 

iii. get: a) updating, rectification or, where interested therein, integration of the data; b) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed; c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected;

 

iv. oppose, in whole or in part: a) for legitimate reasons, the processing of personal data concerning you, even if pertinent to the purpose of collection; b) the processing of personal data concerning you for the purpose of sending advertising materials or direct selling or for carrying out market research or commercial communication, through the use of automated calling systems without the intervention of an operator by e-mail and / or by traditional marketing methods by telephone and / or mail. Please note that the right of opposition of the person concerned, set out in point b) above, for purposes of direct marketing through automated means extends to traditional ones and that it remains however the possibility for the person concerned to exercise the right of opposition even if only in part. Consequently, the data subject may choose to receive only communications by traditional means or only automated communications or neither.

 

Where applicable, you also have the rights under Articles 16-21 GDPR (Right to rectification, right to be forgotten, right to limit processing, right to data portability, right to object), as well as the right to complain to the Guarantor Authority:
